BIY’S COURT IN THE RUSSIAN LEGISLATION ON TURKESTAN REGION

Abstract

The article is devoted to the transformation of Biy’s Court, carried out by Russia in the Turkestan Governorate General in the second half of the 19th century. Based on laws and bills the author shows the transformation the Nomadic National Court underwent beginning with its recognition as one of the elements of the judicial system in the region, through the attempts of a rigid regulation to establishing the general control over it. Throughout the considered period the Russian power couldn’t decide what type of People’s Court (nomadic Biy’s Court, or Kadi’s Court of sedentary residents) was the closest to all-imperial judicial system and less contradicting to the political objectives of the government. The decline of the National Court was contributed by aspiration of the regional administration to interfere in its activity by canceling final sentences and thereby discrediting the idea of the national court proceedings as well as the absence of the unified rules in the organization of the national legal proceedings in various parts of the Turkestan region.
